From November 2008 through the first part of February 2009 Waterloo Police officers conducted tobacco compliance checks of Waterloo businesses that hold tobacco sales permits.  One hundred and seven compliance checks were conducted and of those, six individuals were cited for selling tobacco products to an under age person.  This translates to a 95% compliance rating.  The statewide average last year was 92%, which is far above the statewide average of 50% in 1995.

Those persons cited for selling tobacco to a minor and the businesses where the violation occurred are as follows:

Keith Duane Jamieson, age 40, All Stop Convenience Store 2424 Ranchero Road.
Kayla Lynn Marie Holman, age 21, Mustang Bar 1927 Jefferson Street.
James Jordan Hampton, age 15, Guppy's on the Go 1615 Bishop Avenue.
Michelle Lynn Tucker, age 48, Holiday Station Stores Inc., 1604 LaPorte Road.
Niechea Bray, age 28, CVS Pharmacy 2060 Crossroads Boulevard.
Donald Lee Nichols, age 66, Kum & Go 117 East San Marnan Drive.

The fine for this violation, a simple misdemeanor, is $100 for the first offense, $250 for the second offense and $500 for the third offense.  The business is also subject to a civil penalty.

The Waterloo Police Department participates in the "Iowa Pledge Tobacco Enforcement Project," which is administered by the Iowa Alcoholic Beverages Division.  Officers expect to start the next round of compliance checks within the next couple of weeks.
