UPDATE:

As a result of the investigation at the Kwik Star Store, 1214 Franklin Street, the Waterloo Police Department arrested Daytrell Raymond Pendleton, age 26 of Waterloo. Pendleton is being charged in Black Hawk County District Court with attempted murder, a class B felony.

It was determined that Daytrell Pendleton was at the Kwik Star Store when the victim, Andrew Spates, age 40 of Waterloo, entered the parking lot in a vehicle. Pendleton removed a shotgun from his vehicle and fired multiple rounds striking Spates.

Andrew Spates was transported to Unity Point Health, Allen Hospital, where he underwent surgery. He was later transported to the University of Iowa Hospital and Clinics in Iowa City where he is listed as critical, but in stable condition.

This case remains under investigation.
